Bungoma Court Directs Divorced Couple to Split Children’s Upkeep Costs

A Bungoma Children's Court has directed a divorced couple to share the cost of raising their children equally as their dispute over parental responsibility continues.

The court issued the interim orders on August 20 after the mother asked for the father to take full responsibility for the children's expenses.

The judge instead ruled that both parents must contribute equally towards their children's general upkeep and maintenance until the case is fully determined.

School Fees to Be Shared

The parents must also divide equally the school fees and other education-related expenses for the children's current schools until the end of the academic year.

The court directed the parents to review the children's education arrangements afterward and agree on schools that meet their needs while considering the father's ability to pay.

If they cannot agree, the father will only be required to contribute an amount similar to what he previously paid when the children attended public schools.

The mother will cover any additional costs resulting from placing the children in more expensive schools.

Court Maintains Current Custody Arrangement

The judge ordered the parents to maintain the existing physical custody arrangement until the main case is heard and determined.

Despite the physical custody arrangement, both parents will have equal legal custody.

This means they must jointly participate in major decisions affecting the children, including their education, medical treatment and religious upbringing.

The ruling places financial responsibility for the children on both parents rather than automatically assigning the costs to one parent following divorce.

The case will continue as the court considers the wider dispute between the former spouses.
